Petitioner approached this court being aggrieved by the charge sheet which was submitted before the jurisdictional court in connection with Chakdah Police Station Case No. 560/22 dated 23.08.2022.

The investigation of the case is being carried on by the present Investigating Officer pursuant to the order passed by the learned ACJM, Kalyani. The investigation of the case is in progress.

I find that the Investigating Officer has recorded statement of the witnesses, seized materials in course of further investigation and in the report

submitted before this court narrated an outline regarding the proposed accused persons.

Having considered that the investigation of the case is in progress, prima facie I find that further pendency of the writ petition is unwarranted. The Investigating Officer has also contended in the report submitted before this court that the report under section would be submitted before the jurisdictional court very shortly.

In view of the aforesaid, I direct that the petitioner if he is further aggrieved, he would canvass his issues before the jurisdictional court concerned. With the aforesaid observations WPA 30376 of 2024 is disposed of.

Report so submitted be kept with the record.

A copy of the report be handed over to the learned advocate for the petitioner.

Case diary be returned to the learned advocate appearing for the State.
