The writ petitioner says that he has been working in the school since August 1, 2008 as a clerk. Also that, he has been appointed in compliance with the recruitment rules and the Managing Committee has recommended for his approval in the post.

Therefore, he writes to the respondent District Inspector of Schools, Secondary Education, Murshidabad, vide letter dated November 16, 2016, requesting approval of his appointment.

Md. Manuwar Ali, learned counsel appearing for the petitioner seeks that an order be passed upon the respondent D.I., to consider the petitioner's prayer as above.

None appears for the respondent in spite of service of notice.

In view of the prayer of the petitioner, it is found proper to dispose of the present case by directing as follows:- (i). Let the petitioner file a comprehensive application afresh, before the respondent no. 2, reiterating his prayer as above.

(ii). Let the respondent no. 2 consider petitioner's prayer as above, in accordance with law.

(iii). In doing so, he shall grant an opportunity of hearing to the petitioner and dispose of his application by dint of a reasoned order.

The entire exercise as above shall be concluded by the respondent no. 2 within a period of four weeks from the date of communication of copy of this order.

Since no affidavit is invited, the allegations contained in the petition are deemed to have been denied by the respondents including the private respondents.

This writ petition being WPA No. 31497 of 2017 is disposed of, along with the pending applications, if any.

9.

Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
