The petitioner was serving in the South Bengal State Transport Corporation. A disciplinary proceeding was initiated against him and an order of punishment was passed. Challenging the same, the petitioner preferred an appeal before the appellate authority on March 31, 2024. The same is alleged to be pending disposal till date.

The petitioner retired on January 31, 2025. He has been paid the terminal dues in line with the order passed by the disciplinary authority. The petitioner accepted the dues, however, without prejudice to his rights and contentions.

Prayer has been made to direct the authority to dispose of the appeal.

As it appears that the appeal in question has been pending disposal before the appellate authority for more than two years and the employee has retired in the meantime, it is high time for the appellate authority to decide the appeal preferred by the petitioner in accordance

with law at the earliest but positively within a period of eight weeks from the date of communication of this order.

A reasoned decision shall be passed and communicated to the petitioner.

If the appeal of the petitioner is allowed, or any order passed by the appellate authority setting aside, modifying or varying the order passed by the disciplinary authority, then necessary consequential steps shall be taken by the authority without any further delay.

The writ petition is disposed of.

All parties are to act on the server copy of this order duly downloaded from the official website of this Court.

Certified copy of this order, if applied for, shall be made available to the parties.
