Mr. Surojit Sinha Roy Mr. Tapan Roy .......For the Petitioners Le The petitioners have enclosed the documents which are in their possession relating to agreement as well as the records of Baranagar P. S. Case No. 398 dated 14.06.23 and tried to argue that the present case being Baranagar P. S. Case No. 503/2023 dated 31st July, 2023 wherein charge sheet has been submitted before the learned Additional Chief Judicial Magistrate, Barrackpore is a counterblast.

I find from the charge sheet so submitted in connection with Baranagar P. S. Case No. 503 of 2023 dated 31.07.2023 that the charge sheet which was filed in the month of September, 2023 incorporating amongst other Section 354 B of the Indian Penal Code as well as Section 323.

Having considered the documents under Section 207 of the Code of Criminal Procedure on which the prosecution proposes to rely in order to prove its case are not available and/or enclosed with the revisional application, I am of the view that the petitioners would approach the trial court at the appropriate stage when the documents are made available to the petitioner. No assessment of the case can be made and as such there is no interference in respect

of the subject matter challenged in the revisional application. With the aforesaid observation, CRR 5000 of 2023 is disposed of.
