This application under Article 227 of the Constitution of India is at the instance of the substituted defendants challenging the order dated 11.09.2023 passed by the learned Civil Judge (Junior Division), 1st Court at Barrackpore in Title Suit No.113 of 2021.

By the order impugned, the application under Sections 7(1) and 7(2) of the West Bengal Premises Tenancy Act, 1997 was rejected on the ground that the same was not notorized and the case number and the name of the parties also did not match.

The learned advocate appearing for the petitioners could not satisfy this Court that the application was in form.

For such reason, this Court is not inclined to interfere with the order impugned.

C. O. No.4395 of 2024 stands dismissed accordingly.

The petitioners will be at liberty to take appropriate steps in accordance with law before the learned Trial Judge.
