Learned advocates for the parties are present. Heard learned advocate for the petitioner and the learned advocate for respondent nos. 2, 3 & 4.

It is the grievance of the writ petitioner that the petitioner is charged by the respondent no. 3 of committing the offences under Rule 6 of Legal Metrology (Packaged Commodities) Rules, 2011 which is not maintainable against the petitioner. Learned advocate for the petitioner further draws attention to the representation made by the petitioner being marked Annexure P-5.

Upon hearing the learned advocates this Court is of the view that this writ petition should be disposed by directing the Assistant Controller of Legal Metrology, Hooghly Division, Department of Legal Metrology to consider the representation in accordance with law.

Thus this writ petition is disposed of by directing the respondent no. 3 to consider the representation of the petitioner being Annexure P-5 to the writ petition in accordance with law

within a period of five weeks from the date of communication of this order after giving the writ petitioner an opportunity of being heard.

During consideration of the representation no coercive steps should be taken against the petitioner. Urgent Photostat Certified copy of this order, if applied for, be supplied to the parties upon compliance with all necessary formalities.
