Petitioner has prayed for direction upon the concerned respondent authorities to take steps based on transfer application dated 26th November, 2021 which was made on Utsashree portal on general ground (distance). In reference to a document at page 77 of the writ petition, it is contended on behalf of the petitioner that after transfer application was made on 26th November, 2021 same was not processed by the school authority where petitioner is presently working. School authority is represented by learned advocate who has submitted that petitioner is a

teacher in Bengali and including petitioner there are four Assistant Teachers working in the school in Bengali. However, due to robust roll strength of the school petitioner's application for transfer was not forwarded to the District Inspector of Schools (SE), South 24 Parganas being respondent no.4. West Bengal Central School Service Commission and State respondents are represented by learned advocates.

Having considered the submissions made on behalf of the parties, the writ petition stands disposed of directing the authority of Kaikhali Gopalgunge B.K.R.M. Institution, South 24 Parganas being respondent nos.5 & 6 to forward the transfer application of the petitioner by seven days from the date of communication of this order. On receipt of transfer application District Inspector of Schools (SE), South 24 Parganas being respondent no.4 shall process the same and forward it to the West Bengal Central School Service Commission by fortnight thereafter.

On receipt of transfer application, the Chairman, West Bengal Central School Service Commission being respondent no.3 shall decide the transfer application by six weeks thereafter in accordance with law.

The decision to be taken by the Chairman shall be communicated to the petitioner by ten days thereafter.

It is made clear that transfer application of the petitioner shall not be rejected on the ground of suspension of Utsashree portal.

However, there shall be no order as to costs.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
