(Bail granted) CRM (DB) 4408 of 2024 In re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Singur Police Station Case No. 170 of 2024 dated 15.04.2024 under Section 448/302/34 of the Indian Penal Code, 1860.

For the Petitioner Mr. Debabrata Chatterjee Mr. Sujoy Sarkar ...For the State Sister of both the petitioners before us was found dead at her matrimonial home. Petitioners arrived at the matrimonial home of their sister and found the dead body to be hanging and no steps being taken by the in-laws of their sister. Altercation led to an incident of assault involving the petitioners.

Such assault led to the homicidal death of the victim. Police filed charge sheet.

Considering such aspects of the matter and the fact that the police filed charge sheet, we deem it appropriate to grant bail to the petitioner.

Accordingly, we direct that the petitioners shall be released on bail upon furnishing a bond of Rs. 10,000/- (Rupees Ten Thousand only) each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Learned Additional Chief Judicial Magistrate, Chandannagore, Hooghly subject to the condition that the petitioners shall appear before the learned trial court on every date of hearing until further orders and shall not intimidate witnesses and/or tamper with evidence in any manner whatsoever.

In the event, the petitioners fail to comply with the conditions as enshrined hereinbefore, it is open to the trial court to cancel the bail without further reference to this Court. The prayer for bail of the petitioner is allowed. C.R.M.(DB) 4408 of 2024 is disposed of.
