Dd 2 31.12.2025 WPA/30042/2025 UMAKANTA MAJHI AND ORS VS THE MISSION DIRECTOR, PASCHIM BANGA RAJYA SHISHU SHIKSHA MISSION, GOVERNMENT OF WEST BENGAL Mr. Kamalesh Bhattacharyya, Mr. Bidhan Biswas, Advocates ... ... For the Petitioners Mr. Md. Sarwar Jahan, Ms. Mousumi Mitra, Advocates ... ... For the Respondent
1. The learned advocate for the petitioners and the learned advocate for the respondent are present.
2. Heard the learned advocates.
3. It is the grievance of the writ petitioners that the respondent be directed to accept the representation of the petitioners to relinquish their status as Samprasarak/Samprasarika taking the benefit at per with the para teachers who are initially Samprasarak/Samprasarika and to allow the petitioners to retain their status of Samprasarak/Samprasarika to get the benefit of continuation of service up to the age of 65 years.
4. Upon hearing the learned advocates and upon considering the facts of the case, this Court is of the view that the prayer of the writ petition should be allowed. Thus, this writ petition is disposed of with a direction upon the respondent authority to treat the petitioners as Samprasarak/Samprasarika and the
option that is filed in DCF which the petitioners have exercised be treated as cancelled.
5. This writ petition is disposed of.
6. It is hereby clarified that the writ petitioners will not be entitled to claim the benefit of para teachers in future.
