1. The petitioner's grievance is that an eco-sensitive area in the Mahananda riverbed is being exploited by an illegal crusher plant and therefore, he seeks for appropriate directions.

2. Mr. Ganguli, learned Government counsel has produced the written instruction along with the annexure, which prima facie show that the permission has been granted in favour of a particular company by the Divisional Forest Officer and the stack of the riverbed materials and boulders etc. are for the development of the 4/6 lane of NH-10. Copy of the instruction has been handed over to the learned advocate for the petitioner.

3. In view of the above, the writ petition is disposed of leaving it open to the petitioner to agitate his grievance after going through the documents, which have been furnished by the respondents to the learned advocate for the petitioners.

4. No costs.

5. Urgent photostat certified copy of this order, if applied for, be furnished to the parties expeditiously upon compliance of all legal formalities.
