The present writ petition has been filed by the petitioner seeking grant of new electricity connection to the submersible pump installed on the agricultural land being Dag No. 79 at Mouza - Baidyapur under P.S. Habibpur, Dist. - Malda.

The petitioner had installed the submersible pump for carrying out agricultural activities and had applied for electricity connection vide application no. 3004985103. The respondent authorities conducted an inspection and issued quotation on 01.11.2024. The petitioner had deposited the quotation amount on 06.11.2024.

Learned Counsel for the respondent points out that as per the application filed by the petitioner, he is seeking a load of 5230 watts. In this case SWID Certificate is necessary and connection can only be

given effect to after the petitioner complying with the requirement of the SWID Certificate.

Learned Counsel for the petitioner states that in the present writ petition he is seeking electricity connection having a load of 5 H.P. with a three phase meter connection and no SWID certificate is required in this case.

In view of this discrepancy, this Court grants liberty to the petitioner to withdraw his earlier application and file a fresh one for the grant of new electricity connection. The same shall be done by the petitioner within a period of two weeks from the server copy of this order.

Learned Counsel for the respondent submits that the quotation amount shall be refunded to the petitioner within two weeks from the date of passing of this order. Subject to the petitioner fulfilling all the necessary compliance, the respondent shall raise a fresh quotation amount within one week thereafter. The petitioner shall deposit the quotation amount within seven days after its receipt. Learned Counsel for the respondent states that they shall be in a position to consider the petitioner's application for the grant of new electricity connection within a period of six weeks subject to the fulfillment of all the necessary compliance.

With the above directions, the present writ petition is disposed of.

There shall be no order as to costs.

Let urgent Photostat certified copy of this order, if applied for, be supplied to the parties on usual undertaking.
