1. The petitioner alleges that the portion of his land has been encroached by the Block Development Officer, Tehatta-I, District - Nadia, respondent no. 5 herein.

2. Though the respondents have filed a report, the same seems inadequate. The respondent no. 5 is directed to serve a copy of the sanction for constructing the garbage vat as well as a copy of the map showing demarcation of the two plots viz. Khatian - I and Khatian No. 161/1 in Plot No. 1390 to the petitioner.

3. Let such documents be handed over to the petitioner within a period of seven days.

4. The respondent no. 2 is directed to treat the present writ petition as a representation and decide on this issue as to whether there has indeed been any encroachment on the petitioner's

land or not, upon verifying the sanction of the respondent no. 5 to construct a garbage vat.

5. Respondent no. 2 is directed to dispose of the representation within a period of six weeks from date, positively by January 5, 2026.

6. The writ petition is, thus, disposed of with the aforestated directions.

7.There shall, however, be no order as to costs. 8.Since no affidavit has been called for, the allegations contained in the writ petition are deemed to be denied.

9.Urgent photostat certified copy of this order, if applied for, be supplied to the parties on usual undertaking.
