Heard the learned Advocates for the parties.

We have considered the materials on record. BSF personnel recovered 305 bottles of Fairdyl cough syrup containing codeine phosphate from co-accused travelling in a motorcycle. Complicity of the petitioner has transpired during investigation. Custodial interrogation of the petitioner for progress of investigation is necessary. 3.

Under such circumstances and in view of statutory restrictions under Section 37 of the NDPS Act, we are not inclined to grant anticipatory bail to the petitioner.

Accordingly, prayer for anticipatory bail of the petitioner is rejected.
