02.02.2024 sdas rejected C.R.M.(NDPS) No. 12 of 2024 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Kaliachak Police Station Case No. 693 of 2023 dated 12.06.2023 under Sections 21(c )/27A/29 of the NDPS Act.

Heard learned Counsels for the parties.

Report filed in Court is placed on record.

It appears from the report, sample tested positive for Heroin. Materials on record show recovery of 401 grams of Heroin. This is above commercial quantity. Under such circumstances and in view of statutory restrictions under Section 37 of the NDPS Act we are not inclined to grant bail to the petitioner.

4. Application for bail is, thus, rejected. 5.

Trial court is directed to proceed with the trial with utmost expedition without granting unnecessary adjournment to either of the parties.
