The petitioner is an Assistant Teacher in Karkona Joggeswar F.P. School under Galsi West Circle of DPSC, Purba Bardhaman, the respondent no. 5 herein, he is praying general transfer to any school within the district on the ground that he is a surplus teacher in his school. The petitioner has a pending representation to the said effect with the Secretary of the West Bengal Board of Primary Education through the Chairman of the said Council, the respondent no.6 herein, the said representation dated November 25, 2024 forms part of the writ petition being Annexure-P/5.
The petitioner since is praying transfer to any school within the district, the respondent no.6 is the competent authority to consider his such prayer. The respondent no.6 is directed to consider and dispose of the said representation expeditiously in accordance with law, preferably within a period of four weeks from the date of communication of this order. In the event, it is found that the petitioner is a surplus teacher in his school, his prayer for such general transfer may be considered to any school under the said Council where there is a shortage of teachers.
WPA 30626 of 2024 is disposed of with the above terms and observations without any order as to costs. Since no affidavit has been invited, the allegations contained in the writ petition are deemed to have been denied by the respondents.
