Mr. Mohit Gupta, learned advocate for the appellant on instruction from his advocate-on-record states that the impugned order of the learned court below directing return of the machinery to the respondents borrower is the subject matter of the appeal. Pending its hearing, the receiver has handed over the machinery to the respondents/ borrowers. Hence, now other steps are contemplated and not this appeal.

In those circumstances, this appeal is dismissed as not pressed.

The connected application (CAN 1 of 2023) is disposed of accordingly.
