The petitioner is the Teacher-in-Charge at Patiram Girls' Free Primary School, a school under the Balurghat East Circle of Dakshin Dinajpur District Primary School Council. The Council had initiated a process for recruitment of Head Teachers in the schools of the district.
The petitioner had participated in the said recruitment process. The council, according to the seniority of the candidates, had prepared a panel. The petitioner, according to her position in the said panel, has been recommended for appointment as the Head Teacher of Jhapurshi Free Primary School. The petitioner is not agreeable to join in the said school, instead, is praying that she may be appointed as a head teacher at the school where she is now working on the ground that she is suffering from some illness and has a minor child to look after. The school where the petitioner has been recommended is not only within the same circle as her present school but also, is only five kilometers away from it, besides, if the prayer of the petitioner is entertained, the panel prepared by the Council in terms of the Rule 14 of the West Bengal Primary School Teachers
Recruitment Rules, 2016 would be disturbed, which is not warranted. W.P.A. 30701 of 2024 is therefore dismissed without any order as to costs.
