Report submitted by the learned advocate appearing for the State be also kept with the record. The petitioner has sent communication to the office of the Superintendent of Police, Sundarban Police District which was dated 11.12.2024 for deploying police personnel. There are number of cases already pending and the petitioner is financially losing because of repeated commission of theft at his godown. To that effect, attention has been drawn from the police report that Kakdwip Police Station has registered number of cases which are at the instance of the petitioner as also the proposed accused persons named therein. Number of NCR cases has also been registered by the police authorities.

The petitioner submits that he has applied before the civil court for appropriate relief in respect of the materials kept at the godown which are basically fruits.

Since the Superintendent of Police, Sundarban Police District was approached for deploying police protection, the Superintendent of Police, Sundarban Police District will consider that till the civil court passes any order, at the cost of the petitioner whether it is possible to deploy a police personnel. So far as the other accusations are concerned, the petitioner would approach the jurisdictional criminal court under Section 175(3) of BNSS.

With the aforesaid observations, the writ petition being WPA 30425 of 2024 is disposed of. There will be no order as to costs.
