This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Sr. Division), 2nd Court, Howrah to dispose of Title Suit No.106 of 2006 expeditiously.

The opposite party no.19 is represented by learned advocate.

It has been jointly submitted by the learned advocates for the respective parties that several interlocutory applications are pending.

Learned Advocate for the opposite party no.19 submits that some substitution applications are still pending.

Learned Advocate for the petitioner submits that an application under Section 52 of the Code of Civil Procedure is also pending.

C. O. No. 4405 of 2024 stands disposed of by requesting learned Civil Judge (Sr. Division), 2nd Court, Howrah to make an endeavour to dispose of the

interlocutory applications filed in T. S. No.106 of 2006 as expeditiously as possible without granting any unnecessary adjournment to either of the parties keeping in mind the fact that the suit is pending from the year 2006.

It will be open to the learned Trial Judge to decide which of the applications shall be taken up first.
