Heard the learned Advocates for the parties.

We have considered the materials on record. Petitioner is in custody for five years and five months. On the ground of delay in trial, co-accused have been enlarged on bail. Their orders have been confirmed by the Hon'ble Supreme Court. Petitioner stands on the same footing with the said co-accused and is entitled to similar relief.

Accordingly, the petitioner viz., Harpreet Singh @ Happy Bhai shall be released on bail upon furnishing a bond of Rs.10,000/- with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Additional District Judge, 4th Court, Alipore, South 24Paraganas subject to condition that he shall appear before the trial court on every date of hearing until further orders and
shall not intimidate witnesses or tamper with evidence in any manner whatsoever or commit similar offences in future and on further condition petitioner shall report to the I.O. of the concerned Police Station once in every fortnight and shall not leave the local limits of the local police station without leave of the Court.
5. In the event petitioner fails to appear before the trial court without any justifiable cause, the trial court shall be at liberty to cancel his bail in accordance with law without further reference to this Court.
