Pursuant to an order passed by this Court on August 29, 2023 in WPA No. 19976 of 2023 granting liberty to the petitioner to prefer statutory appeal before the 6th respondent against an order passed by the Additional District Magistrate and District Land and Land Reforms Officer, Purba Burdwan on May 26, 2023, such appeal has been preferred by the petitioner which is pending.

Learned counsel for the petitioner seeks a direction upon the 6th respondent to dispose of the appeal expeditiously and upon the 2nd respondent restraining him from taking any coercive steps in respect of the plot in question.

Learned counsel for the 2nd respondent submits that the plot in respect of which lease was granted in favour of the petitioner has not been put on auction.

Upon consideration of the submission made on behalf of the parties, the writ petition is disposed of directing the 6th respondent to consider and dispose of the appeal pending before him within one month from the date of communication of this order, in accordance with law. Pending disposal of the appeal, the 2nd respondent is restrained from putting the plot in question on auction or encumbering the same in any manner.

With the above observations and directions this writ petition is disposed of.

There shall however be no order as to costs.

Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be furnished to the parties upon compliance of necessary formalities.
