Both petitioners seek an electricity connection at premises no. 155, Mahatma Gandhi Road, Kolkata - 700137. It is an admitted fact that petitioner no. 2 is a tenant of respondent nos. 3 to 10, while petitioner no. 1 is the son of petitioner no. 2.

Learned counsel appearing on behalf of respondent nos. 3 to 5 and 7 to 10 submits that there is no objection to the electricity connection being provided in the name of petitioner no. 2, who is the tenant. However, an objection is raised to the connection being effected in the name of petitioner no. 1.

The report submitted by the Calcutta Electric Supply Corporation Limited (CESC) also affirms that it has no objection to providing an electricity connection at the said premises, subject to the fulfillment of requisite formalities by the petitioners.

In light of the above, the writ petition is disposed of with a direction to the Calcutta Electric Supply Corporation Limited to provide an electricity connection at the said premises in the name of petitioner no. 2, within a period of four weeks from the date of this order, subject to compliance with the necessary formalities by petitioner no. 2.

It is clarified that the grant of electricity connection shall not create or confer any equitable rights in favour of petitioner no. 2, and this order is without prejudice to the rights and contentions of the parties in the suits presently pending between them. Accordingly, WPA 30752 of 2024 is disposed of.

Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
