Admittedly, the father of the petitioner, who diedin-harness, was holding a civil post under the State. The petitioner is seeking compassionate appointment on the death of the employee concerned.

In view of the provisions of section 15 read with section 28 of the Administrative Tribunals Act, 1985, this issue is to be adjudicated by the competent State Administrative Tribunal.

The writ petition is accordingly dismissed as withdrawn with liberty to file afresh on the self-same cause, if any, before the appropriate forum.

The time spent between 20th February, 2024 when the writ petition was filed and today (13.03.2025) shall be construed to be time spent in prosecuting a litigation bona fide before a court without jurisdiction.
