Learned counsel for the petitioner submits that the petitioner was appointed as Executive Assistant of Kanpur Gram Panchayat, Murshidabad and on 3rd July, 1980 and was placed under suspension on 10th June, 2013 for alleged defalcation of fund. FIR was lodged and criminal case was filed which is still pending. The petitioner is on bail.

The petitioner approached this Court in WP 22549 (W) of 2014 claiming disbursal of his retiral benefits alongwith all other admissible dues.

By an order passed on 14th March, 2017 a coordinate Bench of this Court directed the concerned authority to take steps for disbursal of the said amount within four weeks from the date of communication of the order.

Strangely, the order has not been complied with till date. The petitioner seeks compliance of the said order. Upon consideration of the submission made on behalf of the parties, this Court is of the view that since the order passed by the co-ordinate Bench is yet to be complied with, the District Magistrate, Murshidabad, being the 2nd respondent herein, is directed to comply with the said order within four weeks from the date of communication of this order, in its true letter and spirit.

The writ petition is accordingly disposed of. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
