Petitioner has approached this Court as his representation before the police authorities did not yield any result. The allegations made by the petitioner incorporate amongst others that after obtaining knowledge regarding the ATM Debit Card over phone call and under the pretext of compliance of KYC formalities there was unauthorized transactions of Rs.4,97,500/- from his Axis Bank, Savings Account.

Learned advocate for the State submits that on 02.01.2025 Cyber Crime Police Station Case No.02 of 2025 has been registered for investigation and the investigation of the case is proceeding at Cyber Crime Police Station, Jangipur Police District.

In view of the belated registration of the case petitioner is aggrieved. However, having regard to the fact that the police has ultimately taken action for registration of the FIR, they are directed to effectively conduct the investigation, fix responsibility of the delinquent and submit their report under Section 193 of the BNSS before the jurisdictional court within a reasonable period of time.

With the aforesaid observations, WPA 30735 of 2024 is disposed of.

There will be no order as to costs.

Report submitted by the State be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
