By presenting this writ petition, petitioner has prayed for her transfer based on off-line transfer application dated 11th September, 2024. The grounds of transfer are distance between petitioner's residence and her school, distance between petitioner's school and her spouse's workplace and petitioner is having a child of seven years who requires parental care.

Since petitioner was working in the concerned school when Utshasree portal was

alive and reasons which are narrated in off-line transfer application dated 11th September, 2024 were subsisting at the material point of time, she could have made transfer application on Utshasree portal till 29th September, 2022 being last date when portal was alive. After suspension of portal off-line transfer application has been preferred on 11th September, 2024 and the ground for seeking transfer is not any one of the special grounds as provided under amended Rule 4(a) to Rule 4(e) as contained in notification dated 8th September, 2021. This Court does not find it fit to allow off-line transfer application during suspension of portal.

Question would have been different if applicant teacher would have been suffering from terminal disease then as a special case this Court could have exercised discretion.

Moreover, if off-line application seeking transfer on general ground is allowed that will open flood gate.

Hence, writ petition stands dismissed.

There shall be, however, no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
