Ms. Sehanabis, Learned advocate appears on behalf of the petitioner and prays for time for taking instruction from the petitioner in respect of the status of trial of this case. Perused the report submitted by the department from which it appears that the petitioner has expired on October 3, 2016. He annexed the death certificate of the petitioner in his report. The report and the death certificate of the petitioner are taken on record.

In this circumstances, learned advocate for the petitioner fairly submits that this revisional application now becomes infructuous, so it deserves to be dismissed. Accordingly, the revisional application being CRR 4170 of 2015 is dismissed as infructuous.

The interim application, if any, stands hereby dismissed.

Interim order, if any, stands hereby vacated. A copy of this order be served to the learned advocate for the State.

Department is directed to serve a xerox copy of this revisional application to the learned advocate for the State.
