The petitioner is an aspirant for the post of Constable (GD) in Central Armed Police Forces, SSF and Rifleman (GD) in Assam Rifles Examination, 2024.

The complaint of the petitioner is that during the Physical Standard Test measurement of height of the petitioner was such that it should have been taken in a round figure to the next digit as prescribed under the relevant Rules of the selection process and had this figure been accepted then the petitioner might have been within the consideration zone. Learned counsel for the Union of India submits that, the final merit list has already been published on December 13, 2024 and this writ petition has been filed on December

19, 2024. After the entire merit list has been published, the petitioner has challenged the steps taken by the authority rejecting the candidature of the petitioner, such belated writ petition is not maintainable.

After considering the rival contention of the parties and after perusal of the materials on record the fact stated above are admitted by the parties.

The record shows that, this writ petition admittedly is a belated one and was filed after the final merit list was published.

This Court is of the view that, the petitioner was not diligent in pursuing his right. Once the merit list has been published, the law is well settled, a belated writ petition of such nature having been filed after the final merit list having been published, such writ petition should not be entertained.

In view of the foregoing discussions and reasons the instant writ petition W.P.A. 30600 of 2024 stands dismissed, without any order as to costs.
