The petitioner borrowed some amount of money from the bank and was unable to repay the same within the stipulated period of time. For recovery of the loan amount, the bank has proceeded to sell off the property by way of public auction in accordance with the provisions of the SARFAESI Act.

The petitioner, through the learned advocate, has made a representation before the bank praying for settlement of the loan account.

The same is pending.

The instant writ petition is disposed of by directing the Authorized Officer, Bank of India respondent no. 5 to take into consideration the representation made on behalf of the petitioner in accordance with

law at the earliest but positively within a period of four weeks from the date of communication of this order. A reasoned order shall be passed and communicated to the petitioner.

The writ petition stands disposed of.
