19-02-2025 (ct. no. 29) KOLE CRM (DB) 15 of 2025 In re: An application for bail under Section 439 of the Code of Criminal Procedure/Section 483 of the BNSS in connection with English Bazar Police Station Case No. 43 of 2024 dated 08.01.2024 under Sections 120B/489B/489C of the Indian Penal Code. - A n d - In the matter of : Abu Taleb Sk.
.... Petitioner.
Mr. Subhabrata Datta, Ms. Debjani Roy Choudhuri, Ms. A. Saha, Mr. T. Saha, ... For the Petitioner.
Mr. P. Kumar Dutta, Mr. S. Deb Roy, ... for the State.
Dictated by Arijit Banerjee, J:- 1.
The petitioner renews his prayer for bail which was rejected on June 10, 2024 on merits. We do not find any appreciable change since then which would justify reconsideration of the bail prayer of the petitioner on merits. 2.
The petitioner says that he is in custody for about 390 days. Trial has not yet commenced in the sense the charge is not framed as yet. He complains of delay in trial. 3.
Learned State Advocate tells us that three other accused persons are absconding. Proclamation has been issued against them.
4.
Offences involving fake Indian currency notes are serious. They have serious adverse implications on the national economy as a whole. We further see that the other accused persons are absconding which has caused the delay in the trial.
5.
It is quite likely that if enlarged on bail, this petitioner will also disappear into thin air. Hence, we are not inclined to enlarge the petitioner on bail, at this stage.
6.
CRM (DB) 15 of 2025 is, thus, dismissed.
7.
However, considering that the petitioner is in custody for about one year one month, we direct the learned Trial Court to expedite the trial to the fullest extent possible and conclude the same as against this petitioner, if necessary by splitting up the trial and the records in accordance with law.
8.
All parties shall act in terms of server copy of the order downloaded from the official website of this Court. ( Apurba Sinha Ray, J. ) ( Arijit Banerjee, J. )
