Pursuant to the earlier directions passed by this 28.02.2025 Court No. 35 Item No.13 Rakib Court on 27.01.2025, State has submitted a report enclosing the order sheets as well as the injury report. According to the State before the learned Magistrate objections were raised, inspite of the same the learned Magistrate was pleased to grant bail to the accused persons when they surrendered before the Court concerned.
Petitioner approached this Court primarily on the ground that the accused persons were evading the process of law. Presently the accused persons are before the Court, however, there is a grievance of the petitioner presently that the bail in a Sessions triable offence was not granted in accordance with law.
Having considered the present grievance of the petitioner, I am of the view that since there is a specific
provision to be dealt with the same, petitioner would approach the Statutory Authorities and/or the jurisdictional Court empowered to deal with such applications.
Since earlier directions have been passed learned Magistrate would ensure that the witnesses are not threatened and implement the directions passed in WPA 27084 of 2024.
With the aforesaid observations WPA 30816 of 2024 is disposed of.
Report submitted by the State be kept with the record.
Copy of the report be handed over to the learned advocate for the petitioner.
All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
