1. Heard learned Advocates for the parties.
2. Petitioners submit that they did not have any intention to commit murder. They are in custody for 40 days. They pray for bail.
3. Learned lawyer for the State opposes the bail prayer.
4. We have considered the materials on record. Whether injuries are life-threatening may be assessed at the appropriate stage of the proceeding. Petitioners are in custody for 40 days. Their further detention for progress of investigation is not necessary and they may be granted bail.
5. Accordingly, the petitioners, namely, Niren Pramanik @ Hakim, Rabon Tudu, Rajib Tudu, Surajit Pramanik shall be released on bail upon furnishing a bond of Rs.10,000/-each, with two sureties of like amount each, Signed By :

one of whom must be local, to the satisfaction of the learned Chief Judicial Magistrate, Malda, subject to condition that they shall appear before the trial court on every date of hearing until further orders and shall not intimidate witnesses or tamper with evidence in any manner whatsoever or commit similar offences in future. 6.
In the event petitioners fail to appear before the trial court without any justifiable cause, the trial court shall be at liberty to cancel their bail in accordance with law without further reference to this Court.
