Petitioner is not represented.

Md. Nure Zamman, learned counsel on behalf of the opposite party is present.

The instant application is preferred on behest of the petitioner with the prayer for recalling the order dated 22nd December, 2015 passed by this Court.

By passing the order dated 22nd December, 2015, this Court has been pleased to dismiss the revisional application preferred by the petitioner with observation that the dismissal of the revisional application shall not prevent the petitioner from challenging the self-same decree before the appropriate court in accordance with law. Being aggrieved by and dissatisfied with the order, the petitioner has filed this instant application for recalling the said order passed by the court.

It appears that the instant revisional application is pending since the year 2015 and there is reasonable ground

to believe that the petitioner has lost interest to proceed with the present application. So, no purpose will be served by keeping this application pending in the list. Accordingly, the application being CAN 2581 of 2016 filed in connection with C.O. 4519 of 2015 is hereby dismissed for default.

Interim order, if any, stands vacated.

There will be no order as to costs.
