sk Affidavit of service filed by the petitioner is taken on record. On behalf of the writ petitioner, an application being CAN 3 of 2023 is moved. The same is for seeking direction for recalling of this Court's earlier order dated 12th December, 2023 by dint of which the writ petition No. WPA 31695 of 2013 was dismissed for default and restoration of the same in the original file and number. The grounds pleaded as to why the learned advocate could not be present in the Court on the date of hearing of the matter, is with regard to his ill health. The same is found sufficient, being beyond control of the writ petitioner/applicant.

On consideration as above, the prayer of the writ petitioner in CAN 3 of 2023 is allowed.

The order of this Court dated 12th December, 2023 is recalled. The writ petition No. WPA 31695 of 2013 is restored to its original file and number.

It appears that affidavits are complete in this case. Accordingly, it is directed that the matter shall appear as "Adjourned Hearing" in the list on 14.8.2024.

Let a notice to that effect be served upon the learned advocate for the respondents.
