The petitioners are aggrieved by the order dated 4th of October, 2024 passed by the learned Additional District Judge, Fast Track Court-II, Howrah in Title Appeal No.172 of 2008.
The learned Advocate appearing for the petitioners submits that the Trial Court Records were called for by the learned Judge of the First Appellate Court but the same could not be transmitted as the records were not traceable. Learned Advocate for the petitioners submits that an application for reconstruction of the record has been filed but no order has been passed on such application till date.
In the light of the submissions made by the learned Advocate for the petitioners, C.O.4442 of 2024 stands disposed of by directing the learned Additional District Judge, Fast Track 2nd Court at Howrah to take up the hearing of the application for reconstruction of the records on the next date fixed and to dispose of the
same as expeditiously as possible. If the Trial Court Records is not traceable, the learned Additional District Judge, Fast Track 2nd Court at Howrah is directed to take necessary steps so that the Trial Court Records are reconstructed forthwith and the same are transmitted to the learned Judge of the First Appellate Court. Immediately after transmission of the Trial Court Records, the learned Additional District Judge, Fast Track, 2nd Court at Howrah is requested to dispose of the Title Appeal No.172 of 2008 as expeditiously as possible without granting any unnecessary adjournment to either of the parties keeping in mind the fact that the appeal is pending from the year 2008.
There shall be no order as to costs.
Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
