Petitioner is aggrieved by the fact that he had been running a small shop wherefrom he was selling chicken. However, the private respondents in order to grab the said property is trying to throw him out with that end in view has shut down the shop. On being informed the police authorities did not respond. State has submitted a report. Report reflects that the land where the shop has been constructed belongs to PWD Department and no permission was taken from the said authorities for construction of the said shop.

However, if the petitioner is in possession of the shop without due process of law he should not be evicted from the said shop.

Police authorities would ensure that until and unless there is a direction from the civil

administration particularly the PWD Department no individual would interfere with the continuance of trade and business of the present petitioner. With the aforesaid observations WPA 30834 of 2024 is disposed of.

Report so submitted be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
