The petitioner No. 1 is the complainant in this case and the petitioner No. 2 is the charge-sheeted accused of this case, both prayed for quashing of charge-sheet filed in connection with FIR 311 of 2014 dated 13.08.2014 under Sections 354/448/506/34 IPC.
It appears from the status report submitted by learned Advocate for the State that the trial being the Trial No. 61 of 2016 initiated upon the said charge-sheet has already been disposed of by passing the order of acquittal of Muzaffar Ali and Naser Ali from the charges under Sections 354/448/506/34 IPC on 03.02.2016 by learned 7th Judicial Magistrate, Alipore.
Since learned Advocate for the petitioner No. 2 submits that after order of acquittal this application becomes infructuous and deserved to be dismissed.
Accordingly, the revisional application being CRR 4191 of 2015 is dismissed as infructuous.
Interim order, if any, stands vacated.
Interim application, if any, stands dismissed.
Department is directed to supply a xerox copy of revisional application to the State.
