Sufficient grounds are available to explain the delay of 143 days.

The delay is condoned.

Accordingly, CAN 1 of 2024 is disposed of.

There will be, however, no order as to costs. In Re: MAT 1947 of 2014

1. The appeal is directed against the order dated 10th May 2013 where the Court dismissed WP No.

14881 (W) of 2011.

2. The petitioner participated in the selection process for Group-D staff in a particular school under the DI of Schools (S.E.), Hooghly. Interview was conducted on 10th August 2008. Prior thereto by an order dated 5th August 2008 passed by another

Single Bench in WP No. 18552 (W) of 2008, it was directed that the schools must not restrict the selection to only those candidates sponsored by the Employment Exchange. Wide publicity was directed to be given to the vacancy and selection process.

3. The DI of schools found that due publicity had not been given. The panel sent by school could not be approved. The Single Bench in the impugned order upheld the views of DI of Schools (S.E.).

4. This Court, therefore, finds no infirmity in the impugned order. The reference to another decision of a Coordinate Bench dated 9th May 2008 filed by the petitioner permitting him to sit in the selection process cannot come to the aid of the petitioner in the backdrop of the facts of the case. In those circumstances the impugned order calls for no interference.

5. MAT 1947 of 2014 shall stand dismissed.

6. There shall be however no order as to costs.

7. All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court.
