It appears that the present case under Section 482 of the Code of Criminal Procedure arose due to a matrimonial discord between the parties and the present case was amongst various other cases before the respective fora as were preferred by the parties. It is submitted unequivocally by both the learned advocates appearing for both parties that the parties have decided to move the Court for a decree of divorce on mutual consent and in doing so, they agreed to withdraw all other cases pending in different fora, the present case being one of those.
It is further submitted that other cases pending before the various trial Courts have already been withdrawn pursuant to such decision of the parties.
Considering the circumstances as discussed above and the submissions on behalf of the parties, the proceeding in connection with Sonarpur Police Case No.1410 of 2015 dated 30.08.2015 under
Section 498A/342/323/506 of the I.P.C and corresponding to G.R Case No.5428 of 2015 pending before the trial Court is quashed. Parties shall act on the basis of the server copy downloaded from the website of this Court.
