Petitioner is aggrieved by the atrocity inflicted by the private respondents and to that extent informed the police authorities of Mandir Bazar Police Station but the same did not yield any result. Main grievance of the petitioner is that petitioner's husband was mercilessly assaulted, prior to that they were being threatened. So far as the monetary part is concerned, they have been deprived of the same by the private respondents and they were coerced.

The petitioner further submits that lastly on 10.12.2024 a group of persons ransacked the petitioner's house and severely assaulted the petitioner and her husband and the petitioner and her husband were thrown away from the residence.

Mr. Banerjee, learned Additional Government Pleader appear on behalf of the state and submits that state has taken steps immediately on receipt of information and to that extent Mandir Bazar PS Case No. 542/2024 dated 21.12.2024 has been registered for investigation under the relevant provisions of BNS. Be that as it may, in case the petitioner and her husband were earlier staying at the premises referred to in the writ petition and were removed at the behest of certain persons without authority of law and without any consideration, in that case, if the petitioner and her husband approaches before the concerned police authorities, the police authorities would assist the petitioner and her husband to enter into the premises.

The police authorities would also, in that case, keep a strict vigil for ensuring that no breach of the peace takes place.

With the aforesaid observations WPA 30802 of 2024 is disposed of.
