06.01.2025 22-23 sdas Rejected C.R.M. (A) No. 4687 of 2024 with CRM (A) No. 3878 of 2024 In Re : C.R.M. (A) No. 4687 of 2024 In Re:- An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita in connection with Haringhata Police Station Case No. 236 of 2024 dated 11.05.2024 under Sections 498A/304(B)/34 of the Indian Penal Code read with Sections 3/4 of the Dowry Prohibition Act. And In Re : Riyajul @ Riajul Mondal @ Mandal . ..... petitioner Mr. Shibaji Kumar Das .....for the petitioner Mr. Avishek Sinha Ms. Ratna Ghosh ..... for the State 1.
Learned Counsel for the petitioner submits prayer for anticipatory bail was rejected earlier. Co-accused have been granted pre-arrest bail. Accordingly, he prays for anticipatory bail.
2.
Learned Counsel for the State opposes the prayer for anticipatory bail and submits petitioner evaded arrest and prayer has been made for issuance of proclamation. 3.
Apart from the materials on record implicating the petitioner in the crime, his subsequent conduct to evade arrest after rejection of his earlier pre-arrest bail application which has prompted the prosecution to take out application for
issuance of proclamation against him demonstrates he is not entitled to claim parity with other co-accused who are on prearrest bail. Accordingly, we are not inclined to grant anticipatory bail to the petitioner.
4. Hence, prayer for anticipatory bail is rejected. 5.
Petitioner is directed to appear and pray for regular bail within seven days from date. In the event he does so his prayer for regular bail shall be considered independently and in accordance with law.
