Petitioners submit that they have executed a deed of gift in favour of the respondent no. 5. Pursuant to such deed of gift being executed, the respondent no. 5 and her husband were adamant and over trivial dispute with the younger daughter they became arrogant and drove the petitioners away forcefully and locked the room.

Consequently petitioners claim that they have become homeless. In view of the aforesaid, petitioners have submitted a representation with the Officer-inCharge, Magrahat Police Station. However petitioners claim that the same did not yield any result. Having considered that the petitioners claim that they executed a gift deed in favour of the respondent no. 5 which were their property, I direct

that if the petitioners approach the police authorities with proper documents/gift deed, the police authorities would render assistance to the petitioners to enter the residence. Thereafter a lady constable be deputed for visiting every alternate date to ascertain as to whether any physical and mental torture or any sort of coercion is being created upon the petitioners. This arrangement would continue for a period of 4 weeks.

Within the aforesaid period petitioner no. 1 and 2 would approach the appropriate authority under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 for appropriate orders. In case any order is passed, the police authorities would respect and obey such order passed by the appropriate authority.

With the aforesaid observations WPA 30938 of 2024 is disposed of.
