Learned advocate for the petitioner submits that 14.08.2025 Court No. 35 M/L. No.74 Rakib during pendency of the present writ petition the petitioner preferred an application under Section 175(3) of the BNSS pursuant to which Bishnupur PS case no. 135/25 dated 08.02.2025 was registered for investigation.

As none appears on behalf of the State Mr.

Parikshit Goswami, learned advocate who ordinarily appears for the State is directed to represent the State. His appointment may be regularized by the concerned authorities.

Since the case was registered on 08.02.2025, more than 90 days have passed, I direct the investigating officer of the case to inform the petitioner regarding the progress of the investigation. In case the petitioner is aggrieved relating to the progress of the investigation, he would be at liberty to take out an appropriate application before the jurisdictional Magistrate in seisin of Bishnupur PS case no. 135/25, learned Magistrate would assess and ascertain regarding the genuinity of the allegations and pass necessary directions as he deems fit and proper.

With the aforesaid observations WPA 1119 of 2025 is disposed of.

Photostat copy of the FIR submitted by the learned advocate appearing for the petitioner be kept with the record.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
