(NDPS) 6 of 2025 In Re:- An application for bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/Section 439 of the Code of Criminal Procedure in connection with Gazole Police Station Case No.747 of 2023 dated 18-09-2023 under Sections 21(C)/29/25/27A of the NDPS Act.

Petitioner is in custody for more 1 year 4 months. Coaccused have been enlarged on bail by this Court as well as the Apex Court. Petitioner stands on the same footing and is entitled to similar relief.

2. Hence, we are inclined to grant bail to the petitioner.

Accordingly, the petitioner, namely, Raun Sekh, shall be released on bail upon furnishing a bond of Rs.10,000/- with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Additional District Judge, 4th Court, Special Court, Malda, subject to condition that he shall appear before the trial court on every date of hearing until further orders and shall not intimidate witnesses or tamper with evidence in any manner whatsoever or commit similar offences in future.

4. In the event petitioner fails to appear before the trial court without any justifiable cause, the trial court shall be at liberty to Signed By :

cancel his bail in accordance with law without further reference to this Court.
