Learned counsel for the State has placed a report wherein it appears that the matter was fixed for hearing on 13.01.2025 at 3 p.m. by the Controlling Authority under the Payment of Gratuity Act, 1972 in respect of Form - T. The latest status is not with the learned counsel for the State.

4/management submits that the appeal filed by them is pending before the appropriate authority being the Joint Labour Commissioner, Kolkata. The appeal has been preferred on 8th February, 2025.

It is submitted that no communication has been received from the said authority regarding the fate of the appeal. As such, the fate of the said appeal is uncertain.

Considering the materials present before this Court the Controlling Authority is hereby directed to dispose of the case being G-54/2012 within a period of 30 days from the date of this order in accordance with law.

WPA 31018 of 2024 is accordingly disposed of.

There will be no order as to costs.

All connected applications, if any, stand disposed of.

Interim order, if any, stands vacated.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
