Firoz Mr. Arun Shaw ...for the Appellant Learned counsel for the appellant seeks to withdraw the present appeal on the ground that due to inadvertence, instead of preferring the revisional application, the appellant has preferred appeal against the judgment of affirmation passed by the learned Additional Sessions Judge, Ranaghat in criminal appeal no. 8 of 2013 whereby the learned court below had affirmed the order of conviction passed by the Trial court on 27th September, 2013 in case no. 165C of 2007 in a proceeding under Section 138 of the Negotiable Instrument Act, 1881. Upon hearing of learned counsel for the appellant, let CRA(SB) 219 of 2024 be dismissed as withdrawn with liberty to prefer appropriate application against the order impugned, if any, subject to the law of limitation.

Appellant also will be at liberty to take back the certified copy of the judgment passed by the court below after filing authenticated copy of the same before this court. (Dr. Ajoy Kumar Mukherjee, J.)
