Affidavit of service filed in Court today is taken on record.

The petitioner is a citizen of America. He has a Multiple Entry Visa to stay in India issued by the Republic of India on 19th November, 2018 valid till 18th November, 2028. The Visa specifically mentions that each stay will not exceed 180 days.

The petitioner entered India on 23rd October, 2024 and will leave India within the period of 180 days. He is apprehensive that he may be penalized while leaving India.

Learned Additional Solicitor General submits that till 180 days no penalty will be imposed on the petitioner but the moment the petitioner exceeds his stay of 180 days in India, he will be subjected to penalty in accordance with law.

Learned advocate appearing on behalf of the petitioner asserts that the petitioner will leave India within 180 days of his first entry.

The writ petition stands disposed of by observing that the petitioner may not be subjected to any penalty if he departs from India within 180 days of his entry.

7.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
