Petitioners are aggrieved by the fact that they have been assaulted and to that effect they informed the police station, yet no steps have been taken. Petitioners further submit that they are unable to enter their residence and/or carry on their business. State has submitted a report. Report reflects that pursuant to the information so received, Bhupatinagar P.S. Case No.431 of 2024 dated 11.10.2024 was registered for investigation. The police authorities are ready and willing to co-operate with the petitioner no.1, who is a Government licence kerosene dealer and intends to distribute the same at the Government fixed price. Several intimations were sent to the petitioner no.1. However, the daughter of the petitioner no.1 had been to the police station and

informed that due to insufficient stock they are unable to distribute the kerosene oil and they would inform the Bhupatinagar Police Station once they are ready for distribution. An enquiry was conducted by Sub-Inspector of Police attached to Bhupatinagar Police Station. The local residents were examined wherein it was found that there were no obstructions to the petitioners for carrying out their business. Having regard to the fact that the police authorities are ready and willing to extend help to the petitioners and there are no obstructions being created, I direct that in case the petitioners approach the Bhupatinagar Police Station and inform them that they are ready and willing to stay at the appropriate address and also carry on their business, no obstruction be created, both in their livelihood as well as continuance of staying at the residence concerned. With the aforesaid observations, WPA 30936 of 2024 is disposed of.

There will be no order as to costs.

Report so submitted be kept with the record.

Copy of the report be handed over to both the parties.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
