The contempt proceeding arising from an order dated April 21, 2025. The present application has been filed by the alleged contemnor no. 1 praying for modification of the said order on the alleged grounds
mentioned therein. The application will be heard further on the next day.
It is submitted on behalf of the petitioners that the proportionate principle amount has been paid to Shri Harihar Dhar the petitioners/applicants no. 1 being the husband of the deceased employee. The proportionate amount to the children of the deceased employee being the petitioners/applicants nos. 2, 3 and 4 have not been paid. A bunch of copies of communication showing the admissible amount according to the alleged contemnor as per the instruction of the Central Government payable to the petitioners, made over to this Court is taken on record. Copy of the same bunch of document has been made over to Mr. Arup Banerjee, learned advocate appearing for the petitioners/applicants today in Court. Considering the above, since the petitioners/applicants nos.
2 to 4 have not yet received their proportionate admissible amount, upon compliance of all the formalities by the petitioners/applicants nos. 2 to 4 and without prejudice to their rights and contentions, the admissible proportionate amounts shall forthwith be paid to the petitioners/applicants nos. 2 to 4 by the alleged contemnor no. 1 positively within three weeks from the date of communication of this order. The amount shall be credited directly to the respective bank accounts of the petitioners/applicants nos. 2 to 4 by electronic mode of fund transfer.
It is once again clarified that such proportionate payment shall be without prejudice to their rights and contentions of the petitioners/applicants as an interim arrangement. The contempt petition and the connected application shall be heard thereafter on their own merit. The alleged contemnor no. 1 shall file a compliance report showing the payment to be made as directed herein on the next day.
However, the alleged contemnor no. 1 by way of a written communication within two weeks from date shall communicate the petitioners/applicants nos. 2 to 4 if any, further formalities required to be complied with, if not informed to them already.
The matter shall appear under the heading Contempt Application on July 3, 2026.
