It is submitted on behest of the petitioners that during pendency of this case sole opposite party, Pradip Kumar Das had already been expired and his heirs/legal representatives were not brought on record within the stipulated period as enshrined in the Act and as such the instant case has already been abated. It is further submitted on behalf of the petitioners that his client does not want to proceed further with the present case.

So, there is no justification to keep this revisional application alive in the list. Accordingly, the revisional application being CO/4599/2015 is hereby dismissed as non-prosecution.

Interim order, if any, stands vacated.

There will be no order as to costs.
